Use of the BeSafe App and services constitutes agreement and acceptance to the following terms of use.
By using the BeSafe App, herein referred to as the “App”, you are agreeing to comply with and be bound by the following terms of use. Please review the following terms carefully. If you do not agree to these Terms of Use please do not access BeSafe applications or websites.
- You must comply with all the terms of these Terms of Use in order to use the BeSafe App.
- If you create a login and apply for an account to use the BeSafe Application (a “BeSafe Account”), you must provide complete and accurate registration information, and you are responsible for any activity that occurs under your username or account.
- You are responsible for keeping your account and password secure.
- You must not modify, adapt, create derivative work of, reverse engineer, the App.
- You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, profiles, audio and video clips, or links (“Content”) that you submit, post, display and/or distribute on or through the App.
- You must not use the App to harass, threaten, abuse, intimidate, impersonate, or otherwise violate any legal rights (including rights of privacy and publicity) of others.
- You must not disseminate, store or transmit viruses, trojan horses or other malicious code or program.
- You must not create, submit, disseminate, or transmit any unwanted email (“Spam”) to any of BeSafe members.
- You must not use the App for any illegal, or unauthorized purpose.
- You must not, in the use of the BeSafe App, violate any laws in your jurisdiction (including, but not limited to, proprietary rights and copyright laws).
- Violation of these Terms of Use will result in the termination of your BeSafe Account.
- You understand and agree that BeSafe cannot be responsible for the Content posted on the App by members and that you use the App at your own risk. You agree to indemnify, defend and hold us and our partners, attorneys, staff, advertisers, product and service providers, and affiliates (collectively, “Affiliated Parties”) harmless from any liability, loss, claim and expense, including reasonable attorney’s fees, related to your violation of this Agreement or use of the App.
- Your right to use the App is not transferable. Any password or right given to you to obtain information or documents is not transferable.
- BeSafe reserves the right to modify, alter, or terminate the App or these Terms of Use for any reason. If the alterations constitute a material change, as determined by BeSafe in its sole discretion, BeSafe will ask that you accept the new Terms of Use on your next sign in.
- BeSafe reserves the right to refuse service to anyone for any reason at any time.
- BeSafe will remove Content and accounts containing Content that BeSafe determine in its sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Use.
- Links initiated at the App may unintentionally lead to other sites containing information that you may find inappropriate or offensive; sites which contain inaccurate information, false or misleading advertising; or sites containing information which violates copyright, libel or defamation laws. BeSafe encourages you to use discretion when using such links.
- You agree and acknowledge that you have no expectation of privacy with respect to the Internet in general. Please visit the BeSafe privacy policy for more information.
- These Terms of Use are effective as of the time you first access the App and shall continue in full force and effect until terminated as follows: 1. You may terminate your Account for any reason or no reason at any time. Once you terminate your Account, you shall have no further rights or privileges to use the App; or 2. BeSafe may terminate your Account and access to or use of the App for any reason or no reason, with or without notice, at any time.
The information and services provided through the App may contain bugs, errors, problems or other limitations. We and our affiliated parties have no liability whatsoever for your use of any information or service. In particular, but not as a limitation thereof, we and our affiliated parties are not liable for any indirect, special, incidental or consequential damages whether based on breach of contract, breach of warranty, tort (including negligence), product liability or otherwise, even if advised of the possibility of such damages. The negation of damages set forth above is a fundamental element of the basis of the relationship between BeSafe Technologies, Inc. and you. This site and the products, services, and information presented would not be provided without such limitations. No advice or information, whether oral or written, obtained by you from us through the site shall create any warranty, representation or guarantee not expressly stated in this agreement.
BeSafe Technologies, Inc (“BeSafe”) warrants that the information contained in the BeSafe First Responder Information Binder is based on reasonable efforts to compile and analyze the best sources reasonably available to BeSafe Technologies, Inc. at any given time and is accurate to the best of our knowledge as of the date of publication. THE WARRANTY IS IN LIEU OF, AND BESAFE TECHNOLOGIES INC DISCLAIMS, ANY AND ALL OTHER WARRANTIES OR REPRESENTATIONS (EXPRESS OR IMPLIED, ORAL OR WRITTEN), INCLUDING ANY AND ALL IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND WARRANTIES AS TO ACCURACY, COMPLETENESS, OR ADEQUACY OF INFORMATION. ALL RESPONSIBILITY OR LIABILITY FOR ANY DAMAGES CAUSED BY VIRUSES CONTAINED WITHIN THE ELECTRONIC FILE CONTAINING THE FORM OR DOCUMENT IS DISCLAIMED.
- You agree to be solely responsible for any authorized or unauthorized access to your account by any person. You expressly agree that you are solely responsible for any and all acts and omissions that occur under your account or password, and you agree not to engage in unacceptable use of the App or any other BeSafe website or service you can access.
- You represent and warrant to BeSafe that: (i) you have the power and authority and to comply with the terms of these Terms of Use and to perform your obligations under the terms of these Terms of Use; (ii) you will comply with all terms and conditions of these Terms of Use; (iii) you have provided and will provide accurate and complete registration information; (iv) each time you upload Content on the App, you own or otherwise control the rights or have the necessary consents to do so.
- BeSafe may run advertisements and promotions on the App. By using the App, you agree that BeSafe has the right to run such advertisements and promotions. The manner, mode and extent of advertising by BeSafe on the App are subject to change at any time.
